TERMS AND CONDITIONS for the Purchase of Season Pass
Season Pass Purchase Conditions
The season pass holder is subject to all rules and regulations in effect at Snow Creek. The holder is not entitled to any special privileges or exceptions and must obey all rules. Memberships are non-refundable and non-transferable except under the terms noted. *See terms below for Transfers and Refunds.
Season Pass Restrictions and Usage Agreement
I understand that I must present my pass at the ticket window and get a snow pass each session I ski/board. It is for my personal use only. The Pass/membership card cannot be re-sold. Re-selling or allowing another person to use the pass/card constitutes theft of services from Snow Creek.
Snow Creek cannot assume responsibility for snow, weather, amount of pass use (no set number of visits is guaranteed), safety or any other conditions affecting the seasonal member/pass holder or his/her use of the Pass.
In the event of loss or theft of this Pass, holder must notify Snow Creek. Replacements for lost or stolen passes are at the discretion of each resort for a fee of $75.
The Membership Card/Pass shall remain the property of Snow Creek.
Snow Creek assumes no responsibility for unauthorized use of holder's Pass/membership card.
I agree and understand that use of this pass/membership card is a purely voluntary, recreational activity and that if I am not willing to acknowledge the risks, I should not purchase or use this Pass/membership.
I agree and understand that the staff or management of Snow Creek may confiscate my Pass/membership card, if in their judgment I fail to obey ski area rules and directions. Snow Creek management reserves the right to revoke a membership, without refund, at their discretion for any of the following reasons: misconduct, abuse of privileges, violation of the rules, or any other reason they deem necessary. I agree and understand that my Pass/membership card may be cancelled, without refund, or suspended if I abuse my privileges by acts that endanger my life or others. Reinstatement fee for a suspended pass is $50.
Management reserves the right and has the obligation to enforce the Responsibility Code. I must be familiar with and adhere to Your Responsibility Code, which is posted on www.skisnowcreek.com and posted at the Resort. Violations of Your Responsibility Code and other area rules, ordinances and/or guidelines may result in criminal prosecution, civil liability and/or loss of lift privileges without compensation or refund. Applicant acknowledges that skiing is subject to a skiing contract, which releases Snow Creek for injury to person or property.
Transfers, Refunds, Service Charges
Seasonal Program, Group Tickets and all Other purchased Ski ticket use - Express Assumptions of Risks Agreement
I understand and accept the fact that alpine skiing in its various forms is a hazardous sport, and I realize that injuries are a common occurrence. I understand that ice, variations in terrain, moguls, rocks, forest growth and debris, lift towers, snowmaking equipment and other natural and man-made obstacles and hazards, including other skiers, exist throughout the area. I am aware that snowmaking, snow grooming, maintenance and other activities may be in the process at any time, and I agree to stay clear of this equipment. I agree to ski/board in control at all times. I agree, as a condition of being allowed to use the area facility, that I freely accept and voluntarily assume all risks of personal injury or death or property damage, and release Peak Resorts Inc its subsidiaries and its agents, employees, directors, officers, shareholders, and the manufacturers and distributors of equipment (collective 'providers'), from any and all liability from personal injury, death or property damage which results in any way from negligence, conditions on or about the premises, the operation of the area including, but not limited to grooming, snowmaking, lift operations, action or omissions of employees or agents of the areas, or my participation in skiing, snowboarding, accepting myself the full responsibility. I further agree to accept full responsibility for any and all injuries or property damage and agree to defend and indemnify providers for any loss or damage, including any that results from claims or lawsuits for personal injury, death, and property loss and damage related in any way to the use of equipment. I agree to make no claim against the ski area or any of its owners or employees for any injury or harm to me regardless of cause. I agree that any use of this season program or facility confirms absolutely my agreement to be bound by all these terms, and others posted, whether I obtained this season program myself or someone else provided it to me.
I understand that the ski-boot binding system will not release at all times or under all circumstances, nor is it possible to predict every situation in which it will release, and is therefore no guarantee for my safety. I will make no misrepresentations to Peak Resorts Ins and its subsidiaries in regard to my height, weight, age or skier type. In Snowboarding use, I understand that the binding system will not ordinarily release during use these bindings are not designed to release as a result of forces generated during ordinary operation. I accept for use as is the resort rental equipment and accept full responsibility for its care while in my possession. This agreement is governed by the applicable law of this state or province and any claim shall be submitted to the State of Missouri, and no claim or action shall be brought in any other jurisdiction. If any provision of this agreement is determined to be unenforceable all other provisions shall be given full force and effect. I am signing this agreement freely and of my own accord, realizing it is binding effect upon myself, my heirs and assigns, and in the event that I am signing on behalf of any minors, that I have full authority to do so, realizing its binding effect on them as well as myself.
